本所俞伯璋合夥律師接受聯合報記者專訪議題 議題：政府推動南向政策看法與國際學生創業所面臨的問題 （內有採訪影片連結） Ｑ：為何貴事務所支持東協印度人才培育計畫 俞律師： 新政府大力推動南向政策，而東南亞、印度同學在創業往往會遇到法規、語言、環境的問題，新公司設立後會有簽證法律的問題，本所長期的專業經驗可以協助降低法律門檻。但規模不夠大的公司又很難使用這些專業的法律資源，所以本所很樂意提供一些免費的法律諮詢，協助年輕國際學生解決問題，讓他們成為種子，形成一個火苗慢慢發展成一個生態圈，未來也會更願意留在台灣創業。漸漸國際學生來創業就可以和台灣企業成為一個生態圈。希望能讓東南亞印度的學生可以來台灣創業，是友善的。 Q:台灣有什麼優勢讓國際學生來台灣發展？ 俞律師： 台灣的政府有在對國際學生釋出善意，只是速度沒有這麼快。不少企業界也都贊成優秀的國際學生前來。全球的政府也都會面臨一樣的考驗，會讓人民覺得有被剝削的感覺，但台灣是海島國家，需要仰賴國際商務，所以這就考驗著政府的智慧。從語言學習的角度來看，東協印度的同學去日本留學或工作，學習當地語言但可能語言的未來使用性並沒有這麼高。相對學習中文的投資價值在未來較高。國際學生來台灣工作、創業創造價值，投資就會進來，整個環境就會改善。舉例來說，萬國在上海分所：10幾年來，房租每年調升。工資，物價每年調漲，但是中國就是有本錢漲，就是因為全球的資金湧入。當資金充裕時，整體勞動環境就會改善，生活素質提升。 台灣許多年輕人比較沒有機會接觸國際市場，所以相對的想法會比較不會想到全面性的角度。 Ｑ：企業覺得政府的外籍生工作金額過高嗎？ 俞律師： 企業從經營方面來看，只要人才夠優秀，為公司帶來更高價值，其實不太在意薪水。舉例來說：政大知名的肉羹店，成功的秘訣是店長都用陸配或外籍生，因為他們認為認真工作得到該有的報酬，連過年都來開店。雖然這是個案，但或許其他企業會有類似狀況。台灣人也是很優秀的，只是後有追兵。讓優秀國際學生留下，創造新的價值，就會有新的投資案，進而創造更多工作機會。我明白政府、政治人物也有各方壓力，所以必須要大家一起尋找共識。 Ｑ：台灣大概都創什麼業： 俞律師： 我認為是軟體和創新的商業模式，我本身也常回交大協助年輕同學。大部分為科技和軟體產業。現在全球流行的創業團隊有很大一個強項是創新的Business Model，舉例來說Uber 並不買計程車，但就是創新的商業行為創造價值。 近期流行的寶可夢遊戲也是結合實境和遊戲，其實就是商業行為的創新。所以現在的年輕人的的創意是很重要的，而現在的學生也能用創意來得到機會。如果像TSMC一樣就是要看誰的銀彈多，這並不是台灣年輕人能有的機會和資源。 Ｑ：為何萬國願意雇用印度律師，而且印度優秀人才願意留下？ 俞律師： 台灣是多元的國家，對國際人才算是很友善。其實國際人才非常願意來台灣有一個很重要的原因，因為台灣治安很好，可以晚上走在路上。相較其他國家好很多。 雇用印度律師是因為我們有很多國外客戶，國際合約都是以英文制定，而且可以營造講英文的環境。 Ｑ：台灣也不缺乏優秀的英文同學，那有什麼差別呢？ 俞律師： 因為即便是英文非常好的台灣同學，私下可能也不會說英文，但是只講英文的員工，會讓原本不說英文的同仁開始說英文，就連助理也會。進而提升整體員工的競爭力。另一方面是文化衝擊，國外客戶會有各國的法律問題，在解決問題的過程就會有文化的差異。舉例來說：之前台灣客戶在日本有爭議，我們也在日本請當地律師協助處理，台灣客戶無法理解為何處理時間較長且日本代表必須親手寫信，但這就是日本文化，當要和解核談判時，打電話和email是很不禮貌的。 https://www.facebook.com/plugins/video.php…" width="560" height="625" style="border:none;overflow:hidden" scrolling="no" frameborder="0" allowTransparency="true"></iframe> (電腦版請點滑鼠右鍵"在新分頁中開啟連結"觀看影片，手機平板可直接連結)
